Out of Work After a Crash? California State Disability Insurance and the 49-Day Window
If a crash keeps you from your regular work, California's State Disability Insurance may apply. A chiropractor can certify a claim, you must be under care in the first eight days, and you file within 49 days.

Quick answer: If a car accident keeps you from your regular work for at least eight days and you lose wages, California’s State Disability Insurance (SDI) may apply. A chiropractor is on the state’s list of who can certify a claim. “You must be a patient of a Licensed Health Professional in the first eight days of your disability,” and you file “within 49 days of your disability start date.” If you were hurt in a crash in Sunnyvale and cannot work, read this now, because the eight-day rule comes first.
What is State Disability Insurance?
It is a California program, run by the Employment Development Department (EDD), that can pay benefits when you can’t work and lose wages because of illness, injury, surgery, pregnancy or childbirth. EDD calls the benefit Disability Insurance, or DI. If you are eligible, EDD says you can get benefit payments for up to 52 weeks.
Your paystub is a clue. EDD says SDI deductions show as CASDI.
Do I qualify?
EDD says you may be eligible if you:
- Can’t do your regular work for at least eight days.
- Have lost wages because of your disability.
- Are working or looking for work at the time your disability begins.
- Earned at least $300 with SDI deducted from your paycheck.
You also have to be under care. EDD is direct about it: “You must be a patient of a Licensed Health Professional in the first eight days of your disability. You must remain under care and treatment to continue receiving benefits.”
Only EDD can decide whether your claim qualifies. What follows is a map of the process, not a ruling on your case.
Can a chiropractor certify the claim?
A chiropractor is on EDD’s list of licensed health professionals who can certify claims, along with medical and osteopathic physicians, podiatrists, optometrists, dentists, psychologists, nurse practitioners and others.
Tell Dr. Tony at your first visit if you cannot do your job. That is the moment to bring it up, not week three.
“He also helped me apply for state disability benefits and walked me through the process so I felt more at ease,” wrote Tiffany Chen in a Google review, about her care after a car accident.
What are the deadlines?
There are three numbers to keep straight, and they all come from EDD:
| When | What EDD says | What it means for you |
|---|---|---|
| First 8 days of your disability | You must be a patient of a licensed health professional | Get seen early if you cannot work |
| Day 9 at the earliest | Wait nine days after your disability starts to file | Filing on day one can cause delays, loss of benefits or disqualification |
| Day 49 at the latest | File within 49 days of your disability start date to avoid disqualification | Put the date on your calendar now |
If you have a good reason for filing late, EDD says to provide that explanation when you file. It does not promise that the reason will be accepted. If you have questions about your claim start date, EDD’s page lists a number to call before you file.
How do I file?
EDD says the fastest and easiest way is SDI Online. The steps, in short:
- Gather your information. Your full legal name and date of birth as shown on your ID, Social Security number, your most current employer’s name, phone and mailing address, and the last date you worked your normal duties. You may also need a valid photo ID.
- Create a myEDD account. You will get an email with a link to confirm it, and EDD says the link expires within 48 hours.
- Register for SDI Online. You may also need to verify your identity through ID.me.
- File your claim. Submit Part A, the Claimant’s Statement, then save your receipt number. EDD says you must provide this number to your licensed health professional.
- Get the medical certification done. Your licensed health professional finds your claim in SDI Online using your receipt number and completes the certification.
EDD says your claim will not be processed until it receives both your part and the medical certification. So the deadline is really about both pieces arriving in time.
What happens after I file?
EDD says it will contact you with the status of your claim, usually within 14 days. It says your employer will be notified that you have submitted a claim, but that medical information is confidential and will not be shared with your employer.
Does this replace my auto insurance claim?
No. It is a separate program with its own rules. If your crash means several things are running at once, keep a list:
- Your SR-1 report to the DMV, due within 10 days if anyone was hurt.
- Your MedPay coverage, if you bought it. Coverage varies by policy and case.
- Your SDI claim, within 49 days.
- Your attorney, if you have one. Tell them about the SDI claim, and ask how it affects your case.
Hurt on the job instead? EDD asks for workers’ compensation claim information if you have it, and the work injury page has California’s 30-day reporting rule.
What should I tell the doctor at my first visit?
Be specific about your job. “My back hurts” is less useful than “I lift 40 pounds all day and I can’t” or “I sit for eight hours and my neck locks up.” Say what you can’t do, and from what date. Then ask whether Dr. Tony can complete the certification for your situation, and what he needs from you.
Why choose Tropea Chiropractic after a crash in Sunnyvale?
Dr. Tony Tropea treats car accident injuries and whiplash at 182 S Murphy Ave and documents your care from the first visit. Most accident patients are seen the same day, which matters when an eight-day rule is running. No referral is needed, and the office serves patients in English and Spanish. EDD’s pages are available in Spanish too.
The office also treats patients from Cupertino and San Jose. Call (408) 329-9604.
